Water Law
Colorado water rights are a person’s or entity’s right to use the waters of Colorado. They are based on the priority of a party's acquisition of a certain amount of water, in a certain place, for certain uses. Water in Colorado is treated as a private property right that is bought and sold and can be separated from the land it is on. The owner can lease or sell the rights to others, apart from the rights to the land. These transactions must be properly recorded. The ownership rights are tracked through title and deed research, much like with land transactions.
